Pool Designer Terms

Version 2026-09-17 · Effective September 17, 2026. These terms (the "Designer Terms") govern the free Pool Designer at ecopool.com/pool-designer/ and everything you create, upload or receive through it (the "Designer"). They are in addition to the Ecopool Terms of Use and the Ecopool Privacy Policy, which also apply. If these Designer Terms conflict with the Terms of Use, these Designer Terms control for the Designer.

By opening the Designer, choosing or changing a design, uploading a photo, generating a rendering, saving, sharing, emailing or sending a design to Ecopool, or ticking a box that refers to these terms, you accept these Designer Terms. If you do not agree, do not use the Designer.

1. Who may use the Designer

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding agreement. If you use the Designer for someone else, you confirm you have their permission to share their photos and details and to agree to these Designer Terms on their behalf.

2. What the Designer is

The Designer lets you pick and adjust a swimming pool concept, see an overhead layout drawing, place the concept in a photo of a backyard, generate a computer-made illustration of the result, compare estimated cost ranges for different ways to build it, and see whether an Ecopool product is a close match. Ecopool provides it free of charge. Ecopool may change, limit, suspend or discontinue any part of the Designer at any time, and may limit how many renderings, saves or requests a person, device or network address can make.

3. Definitions

• "Photos" are the backyard photos and any other images you upload, plus the versions the Designer makes from them (resized copies, the copy with the pool placed on it, cropped or scaled versions).
• "Designs" are the choices you make in the Designer (shape, size, features, look, installation, equipment, budget, ZIP and similar) and the layout drawings, summaries and share cards generated from them.
• "Renderings" are the computer-generated illustrations produced from your Photos and Designs, including every intermediate and alternative version.
• "Your Content" means Photos, Designs and Renderings together, and anything else you enter into the Designer, such as notes on a quote request.
• "Usage Data" means records of how the Designer is used: a random identifier stored in your browser, a session identifier, the screens you visit, the options you choose, timing, page and referrer, device and browser information, a hashed network address, and the version of these terms you accepted.

4. Your Content: ownership and the license you give Ecopool

You keep whatever ownership rights you have in your Photos. Ecopool owns the Designer, its catalog, presets, drawings, layouts, code and generated images, and, as between you and Ecopool, owns the Renderings and Designs the Designer produces, subject to the license to you in Section 8.

License. In exchange for free use of the Designer, you grant Ecopool, its affiliates, successors and assigns, and the service providers, dealers, installers and builders working with Ecopool, a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free and fully paid license to store, host, copy, reproduce, reformat, resize, crop, annotate, combine, modify, adapt, translate, create derivative works from, analyze, index, display, perform, publish, distribute and otherwise use Your Content and Usage Data, in any media now known or later developed, for any purpose connected with Ecopool's business, including:

1. Providing and improving the Designer — generating your layouts and Renderings, keeping your saved designs and share links working, reviewing quality, fixing problems and developing new features;
2. Training and improving software and AI — using Your Content and Usage Data, alone or combined with other data, to train, fine-tune, test, evaluate, benchmark and improve machine-learning models, prompts, rendering pipelines, matching and pricing logic and other automated systems, whether operated by Ecopool or by its service providers, and to create datasets, statistics and derived works from them;
3. Quoting, sales and installation — letting Ecopool staff, dealers, installers and builders view Your Content to review, price, plan and build a project, and contacting you about it;
4. Marketing and publishing — showing Your Content, in whole or in part, edited or unedited, on Ecopool's websites, social media, advertising, presentations, printed material, galleries of example designs and similar channels, with or without attribution; and
5. Records and compliance — keeping copies for records, security, dispute resolution and legal obligations.

No compensation. You agree you will not be paid for any use of Your Content or Usage Data, now or in the future, and that Ecopool has no obligation to use, display, credit or return Your Content.

Waivers. To the fullest extent the law allows, you waive and agree not to assert any moral rights, rights of attribution or integrity, publicity or privacy rights, or similar rights in Your Content against Ecopool or anyone acting under this license. You will not use any such rights to limit Ecopool's use of Your Content as described here.

Confidentiality. Your Content is not confidential. Do not upload anything you need kept secret. Ecopool staff and contractors may view Your Content, and Renderings and Designs are visible to anyone who has a share link.

Survival. This license survives your deletion of Your Content, your request that Ecopool delete it, and the end of these Designer Terms, to the extent Your Content has been incorporated into models, datasets, statistics, derived works, published material, quotes, records or backups, and to the extent Ecopool needs it for the purposes above.

5. What you promise about Your Content

For every Photo and everything else you upload or enter, you represent and warrant that:

• you took the Photo yourself or otherwise own it, or you have all permissions needed to upload it and to grant the license in Section 4, including from any co-owner, landlord, homeowners' association or photographer;
• it shows your property, or property you have permission to use in this way, and it does not show identifiable people, license plates, private documents or anyone else's private space;
• it does not infringe or misappropriate anyone's copyright, trademark, privacy, publicity or other rights, and does not contain anything unlawful, defamatory, obscene, hateful, harassing or misleading;
• the details you give about yourself and your project are accurate and belong to you or you are authorized to provide them; and
• your use of the Designer does not violate any law, contract or third-party right.

Ecopool may remove or refuse any content, and may block any person, device or network address, at any time and for any reason, without notice.

6. Acceptable use

You may use the Designer only for planning a pool for a property you own, rent or are helping someone with. You may not: use automated tools to access the Designer or to generate renderings in volume; work around usage limits, consent screens or security measures; upload malicious files; misrepresent who you are; use the Designer to build or train a competing product; copy Ecopool's catalog, images or code; or use Renderings or Designs to suggest that Ecopool or anyone else has approved, engineered, priced or agreed to build a specific project.

7. Renderings, layouts, matches and cost estimates are concepts

Everything the Designer shows is a concept, offered for illustration and early planning only.

• Renderings are computer-generated pictures. They are not to scale, do not represent how a pool will actually look or fit, may be inaccurate, incomplete or physically impossible, and may differ every time they are generated. They are not construction drawings, plans, surveys, engineering or site assessments.
• Layouts and dimensions are approximate concept dimensions measured at the water's edge. They do not verify property lines, setbacks, easements, utilities, slopes, soil, drainage, access or permits. Placing a pool in a photo does not mean it fits or may be built there.
• Cost figures are estimated ranges built from published Ecopool catalog prices and general benchmarks, with stated assumptions and limitations. They are not quotes, offers or guarantees. Actual costs depend on your site, region, access, installer, options and market conditions, and figures without an approved basis are shown as not yet estimated.
• An "Ecopool match" is a comparison with a catalog configuration. It is not an approval of your site or a commitment to supply or build anything. Any sale is governed by a separate written agreement.
• No professional advice. The Designer does not provide engineering, architectural, legal, financial, safety or code advice. Consult licensed professionals and your local authority before building.

8. Your license to use Renderings and Designs

Ecopool grants you a personal, non-exclusive, non-transferable, revocable license to view, save, print and share the Renderings and Designs you generate for your own non-commercial planning of a pool and to discuss it with contractors, family and advisors. You may not sell them, present them as Ecopool's approval or as construction documents, remove Ecopool marks or notices, or use them to advertise a business. Renderings may include Ecopool branding.

9. Saving, share links, email and quote requests

Saved designs, Photos and Renderings are stored by Ecopool. A share link opens your Design and its Rendering for anyone who has the link; treat share links as public. Links do not contain the original Photo file, but Renderings show your backyard. When you email a design, use the address you have the right to use. When you request a quote or review, your name, contact details, project ZIP and notes are sent with your Design, Photos and Renderings to Ecopool and may be passed to the dealer, installer or builder who will handle your project; the communications consent in the Ecopool Terms of Use applies.

10. Usage Data, device identifiers and third-party services

The Designer records Usage Data as described in Section 3, whether or not you upload anything, and links it to a random device identifier stored in your browser and to any Designs, Renderings and requests you make. Ecopool uses Usage Data for the purposes in Section 4, for analytics, for enforcing usage limits and for security. Ecopool uses third-party providers to host the Designer, generate Renderings (currently Google's generative AI services), send email and measure usage; Your Content and Usage Data may be processed by them under their own terms and security practices. Personal information is handled as described in the Privacy Policy.

11. Deletion requests and retention

You may ask Ecopool to delete stored Photos and Renderings connected to a design or contact detail by using the Contact page and giving the design link or the email address used. Ecopool will delete reasonably identifiable copies from its active systems within a reasonable time, except where retention is required for a quote, order, dispute, security investigation, backup cycle or legal obligation. Deletion does not affect models already trained, datasets, statistics, derived works, published material or Usage Data, and does not revoke the license in Section 4 for those uses. Ecopool may delete Your Content at any time without notice and has no obligation to keep it available.

12. Ecopool's intellectual property and feedback

The Designer, including its catalog, presets, illustrations, layouts, cost tables, matching logic, software, text and trademarks, belongs to Ecopool or its licensors and is protected by intellectual-property laws. Nothing in these Designer Terms transfers any of it to you. Any suggestions, ideas or feedback you give about the Designer may be used by Ecopool freely and without obligation to you.

13. Disclaimer of warranties

THE DESIGNER AND EVERYTHING IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION. ECOPOOL DOES NOT WARRANT THAT ANY RENDERING, LAYOUT, MATCH OR ESTIMATE IS ACCURATE, COMPLETE, BUILDABLE, PERMITTED OR AFFORDABLE, OR THAT YOUR CONTENT WILL BE STORED, AVAILABLE OR RECOVERABLE. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ECOPOOL AND ITS OWNERS, EMPLOYEES, CONTRACTORS, DEALERS, SERVICE PROVIDERS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PHOTOS, GOODWILL OR PROPERTY VALUE, OR FOR ANY DECISION, PURCHASE, CONSTRUCTION OR EXPENSE MADE IN RELIANCE ON THE DESIGNER, EVEN IF ADVISED OF THE POSSIBILITY. ECOPOOL'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE DESIGNER WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You will defend, indemnify and hold harmless Ecopool and its owners, employees, contractors, dealers, service providers and affiliates from any claim, demand, loss, liability, cost or expense (including reasonable attorneys' fees) arising from Your Content, your breach of these Designer Terms, your violation of any law or third-party right, or any project built in reliance on the Designer.

16. Changes to these terms

Ecopool may change these Designer Terms at any time by posting a new version with a new version date on this page. Changes apply from posting; using the Designer after that, or accepting the new version in the Designer, is acceptance. The license you granted for content uploaded under an earlier version continues under that version's terms and under the new terms.

17. Termination

Ecopool may end or restrict your access to the Designer at any time. Sections 4, 5, 7, 8 (as to Ecopool's rights), 10 through 15 and 18 survive termination.

18. Governing law, disputes and general terms

These Designer Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws rules. Any dispute relating to the Designer will be brought exclusively in the state or federal courts located in Bell County, Texas, and you consent to their jurisdiction, except that Ecopool may seek injunctive relief anywhere to protect its intellectual property or content. If any provision is unenforceable, the rest remains in effect and the provision is enforced to the greatest extent allowed. Ecopool's failure to enforce a provision is not a waiver. You may not assign these Designer Terms; Ecopool may assign them freely. These Designer Terms, the Ecopool Terms of Use and the Privacy Policy are the entire agreement about the Designer.
